Brandi Law Firm Apointed Lead Counsel in California Zicam Litigation

On December 23, 2010, Thomas Brandi was appointed lead counsel for the California Zicam Class Action by the Honorable Richard Kramer of the San Francisco Superior Court. Two other Brandi Law Firm attorneys were appointed with Mr. Brandi, Terence Edwards and Casey Kaufman, and together they will represent Californians who have suffered as a result of their use of certain Zicam products.

Zicam Loss of Smell Lawsuit

FDA, Zicam, and Loss of Sense of Smell (Anosmia)
The FDA has received more than 130 reports of anosmia (loss of the sense of smell) associated with the use of the above Zicam products. The loss of sense of smell associated with Zicam use may be long-lasting or permanent. In addition, individuals have reported losing sense of smell after using Zicam for the first time and after using multiple doses of the product. Zicam contains zinc gluconate, which has long been associated with loss of smell.
Loss of the sense of smell can also affect the ability to taste. The loss or impairment of the senses of smell and taste, poses both quality of life (inability to taste foods or enjoy fragrances) and safety (inability to detect danger signals such as smoke, gas, or spoiled food) issues.
Zicam manufacturer Matrixx Initiatives, Inc., has had to remove several varieties of Zicam nasal cold remedies from the market because of their association with anosmia (loss of the sense of smell). We have filed a lawsuit on behalf of our clients who lost their ability to smell, and in some cases taste, after using a Zicam nasal gel or swab to treat or prevent a cold.
On June 16, 2009, the Food & Drug Administration (FDA) warned consumers not to use three Zicam products – Zicam Cold Remedy Nasal Gel, Zicam Cold Remedy Swabs, and Zicam Cold Remedy Swabs, Kids Size – because of reports of anosmia in some users. At the same time, the FDA issued a warning letter to Matrixx Initiatives stating that three Zicam products could not be marketed without agency approval and that the products did not include adequate warnings about the risk of anosmia.
Victims of Zicam anosmia could have easily been spared their pain and suffering, as the association between Zicam nasal gels and swabs and the loss of smell and taste was well-known long before the FDA issued its alert. In fact, Matrixx Initiatives actually paid $12 million to settle a class action lawsuit in 2006 with hundreds of people who blamed Zicam for their inability to smell and taste. Yet even after the settlement, Matrixx Initiatives continued to market Zicam nasal swabs and gels as a safe remedy for the common cold.

Macy’s Accused of Selling Fake Rubies and other Gems

A lawsuit filed The Brandi Law Firm alleges that Macy’s intentionally deceived its customers by misrepresenting the quality of jewelry, gems and stones it sold to customers throughout California and the United States including misrepresenting heavily glass filled and often heavily lead glass treated stones as natural rubies; selling gems from banned countries; selling Praseolite (a heated form of quartz) as “green amethysts”; and passing off black sapphires as “diamonds.”
One of Macy’s deceptive practices, selling artificially enhanced rubies as natural, received national attention during a story aired on Good Morning America that can be viewed here.

Thomas Brandi Appointed to YAZ Plaintiff’s Executive Committee

Judge Carolyn Kuhl of the Los Angeles Superior Court has appointed Thomas J. Brandi and only four other lawyers to the Plaintiff’s Executive Committee in the California YAZ litigation. As a member of this committee, Brandi help lead the fight for California women suffering pulmonary embolism, strokes, clots, and other injuries from this unsafe birth control product.

Judge Rules Hershey Employees can Pursue Class Action

Magistrate Judge Bernard Zimmerman, of the United States District Court for the Northern District of California, has ruled that all Retail Sales Representatives (RSRs) employed by The Hershey Company in the United States from August 2007 through the present may join a lawsuit pending before the Court seeking past overtime pay.

FDA Placed Severe Use Restrictions for Avandia

The FDA announced in September that they are placing severe restrictions on the continuing use and prescription of Avandia. The European Medicines Agency (Europe’s version of the FDA) went even further, banning the advertising, marketing, or sale of Avandia. Under the FDA’s restrictions, a doctor will have to certify that their patient has tried all other diabetes drugs without success. In addition, the patient will have to sign a detailed consent form outlining the cardiovascular risks associated with Avandia and any other available treatment options.

Thomas Brandi Appointed by Chief Justice to Judicial Council

On October 7, 2010, California Chief Justice Ronald George reappointed Thomas J. Brandi to a new three-year term on the California Judicial Council’s Civil and Small Claims Advisory Committee. Mr. Brandi joins 18 Judges and other selected attorneys in assisting the Courts in identifying concerns confronting the judiciary in the areas of civil procedure, practice, and case management, and suggests appropriate solutions and responses. Casey Kaufman Elected Chair of the CAOC New Lawyers Division

Casey Kaufman has recently been elected Chair of the New Lawyers Division of the Consumer Attorneys of California. This state-wide organization of over 3,000 attorneys who are devoted to preserving access to justice and the constitutional right to a trial by jury for all Californians and resisting efforts to curtail these rights. Founded in 1961, the CAOC also promotes changes to California law by legislative, initiative, or court action to further guarantee Californians’ access to justice.
